What is mediation?

The mediator provides some alternate resolution to each of the party’s. Both the parties are discouraged to intervene in between, especially when one of the parties is presenting, they are required to listen patiently.

Stage 3: a joint discussion

The mediator then encourages both parties to give their response on the opening statement, upon which the process shapes up further. There is a discussion related to the response given by each party upon which issues are bought to notice, and together they try to simultaneously resolve it.

Stage 4: a private discussion with the negotiator

Each part indulges in a private conversation with the mediator, separately in different rooms; to discuss their expectation, strength and offers they are ready to take. The mediator analyses both the sides and tries to come to a concluding offer, keeping in mind both the parties.

Stage 5: a dual intercession

After a personal meeting, the negotiations begin again directly, until they reach any kind of settlement.

Stage 6: the closing of the negotiation

If both the sides reach some conclusion, this is where the deal is pen down, after which the agreement is legalised and signed by both parties. However, if they do not reach conformity, either party is offered an option to continue with the conciliation otherwise the case is then forwarded to the court where the decision of the judge and the panel of adjudicators is considered as the final say.
